Agreement and operator

These Terms govern your use of Oops Calorie, operated in the Philippines by Van Alfred P. Sabacajan under the public developer name ChimkenNuggyszDev. By creating an account or continuing after a material update, you agree to the current Terms and acknowledge the Privacy Policy. If you do not agree, do not use the service.

Adults only

You must be at least 18 years old and legally able to enter this agreement. Oops Calorie is not directed to children. You must provide accurate account information and keep your credentials secure. You are responsible for activity performed through your account unless you promptly report unauthorized access.

General wellness service

Oops Calorie is a calorie, macronutrient, and meal-tracking tool for general wellness and educational use. It is not a medical device and does not diagnose, treat, cure, or prevent any medical condition. It does not provide medical advice, emergency assistance, or a substitute for a dietitian, physician, or other qualified professional. Consult a qualified healthcare professional before making decisions that may affect your health.

AI estimates and your review

Meal identification, ingredients, portions, calories, macronutrients, ranges, and Coach Cal guidance are estimates generated from limited information and may be incomplete or wrong. Photos cannot reliably reveal exact weight, recipes, oils, sauces, preparation methods, or hidden ingredients. You must review and correct results before relying on or confirming them.

Do not use Oops Calorie for medication dosing, diagnosis, treatment, clinical nutrition, eating-disorder treatment, allergy safety, or emergency decisions. If tracking food or weight feels distressing or unsafe, stop using the app and seek appropriate professional support.

Your content and permission to process it

You retain ownership of meal photos, descriptions, corrections, and other content you submit. You confirm that you have the right to submit that content and that it does not unlawfully include another person’s information or intellectual property.

You grant Oops Calorie a limited, non-exclusive permission to host, copy, transmit, analyze, format, and display your content only as needed to provide, secure, maintain, troubleshoot, and improve the service as described in the Privacy Policy. This permission ends when the content is deleted, subject to limited backup, security, and legal retention.

Acceptable use and AI safety

You may not use Oops Calorie to break the law, violate another person’s rights, upload malicious or deceptive material, probe or bypass security, interfere with the service, automate abusive requests, resell access, evade plan limits, or generate or facilitate harmful, fraudulent, hateful, sexually exploitative, or otherwise prohibited content.

You may report an unsafe, offensive, or seriously inaccurate AI result within the app or through Support. We may investigate reports, limit access, remove content, or suspend accounts when reasonably necessary to protect users or the service.

Availability and changes

Features, free allowances, subscription benefits, supported devices, providers, models, and availability may change as the product evolves. We may suspend or discontinue functionality for maintenance, security, legal, provider, or operational reasons. We will provide reasonable notice when practical for material changes that adversely affect paid access.

Account suspension and deletion

You may delete your account at any time through the app or request deletion through https://oopscalorie.com/delete-account. We may restrict or terminate access for serious or repeated violations, security threats, fraud, legal requirements, or risk of harm. Account deletion does not automatically cancel a Google Play subscription.

Disclaimers and liability

To the extent permitted by law, Oops Calorie is provided “as is” and “as available.” We do not promise that estimates, reports, AI output, or the service will be exact, complete, continuously available, or suitable for a medical or clinical purpose.

To the extent permitted by law, the operator is not liable for indirect, incidental, special, consequential, or punitive losses arising from use of the service. Nothing in these Terms excludes liability or consumer and privacy rights that cannot lawfully be excluded or limited.

Governing law, changes, and contact

These Terms are governed by the laws of the Republic of the Philippines, without limiting mandatory rights that apply in your place of residence. Disputes should first be raised through Support so the parties can attempt a good-faith resolution.
